The signer must be aware and willing

A notary confirms that the signer is aware of what they are signing and is signing willingly, without pressure, at the time of the appointment. If the signer is not responsive or is being pressured, the notary cannot proceed. A notary does not assess medical capacity, that is a question for medical and legal professionals.

Acceptable photo ID

The signer still needs a current, acceptable government-issued photo ID. If the ID is at home, arrange to have it brought to the appointment. Texas allows credible-witness identification in limited situations, so ask in advance if ID is a concern.

Common documents

These visits often involve powers of attorney, medical or financial directives, deeds, and affidavits. The notary witnesses the signature and completes the notarial certificate. The notary does not draft the document or advise which one to use.

Access and timing
